New legislation now in effect

Changes to legislation regarding health and safety came into effect on June 1, 2014.

Employers are advised to review the changes and make any adjustments, if necessary, to meet the new requirements for orientation and training of new employees, workplace incident reporting, safety policy and health and safety programs.

Starting on September 1, 2015, officers will begin looking at the new requirements for employers with 20 or more employees in the province to implement a health and safety program.

Getting ready for your workplace inspection

Workplace inspections from health and safety officers on the new legislation will be gradual. Employers should prepare for a visit from a WorkSafeNB officer by reviewing the resources and by completing the checklist(s) below.

Workplace inspection results

Between September 1, 2014 and December 31, 2014 WorkSafeNB’s health and safety officers conducted workplace inspections and investigations using a checklist focusing on legislative amendments that came into effect June 1, 2014. The initial round of inspections paid particular attention to three topics:

• The requirement for employers with 20 or more employees regularly employed in New Brunswick to have a safety policy.
• Ensuring orientation and training for ‘new employees’ that had started work with the employer since June 1, 2014.
• The new requirements for reporting of accidents to WorkSafeNB.

During the four-month period, officers completed 2,330 inspections. The checklist was applied on 409 inspections selected from their annual work plan and on investigations.

A total of 485 orders were written to employers to comply: 97 (20%) on safety policy: 39 (8%) on incident reporting to WorkSafeNB; and, 349 (72%) on sections of the legislation on orientation and training of new employees. The orders written on orientation for new employees are as follows:

• 10% for the employer to provide orientation.
• 57% related to the content included in the orientation that was provided.
• 5% on the employer requirement to retain records of the orientation and training for three years.

The visits resulted in 210 (51.3%) employers being in full compliance with the checklist requirements and 199 (48.7%) receiving compliance orders.

Employers and workers are encouraged to use the resources above to prepare for inspections on these topics and on health and safety program requirements in workplaces.
