Review and appeal

There may be times when you disagree with a claim decision and an objective review of the decision can be helpful. Reporting to WorkSafeNB’s General Counsel, the Decision Review Office (DRO) operates independently of WorkSafeNB’s case management, adjudication and benefit payment services. The team is committed to reviewing your decision to determine that it was made consistent with legislation, policy and the merits of the case.

 

Before you start: 

  • You must request the review within 90 days of the original decision date.
  • The decision must be related to the Workers' Compensation Act, Firefighter’s Compensation Act or the Workplace Health and Safety and Commission and Worker’s Compensation Appeals Tribunal Act.*

Frequently asked questions

Advocates Services can help you file a review with WorkSafeNB's Decision Review Office or an appeal with the Worker's Compensation Appeals Tribunal (WCAT). The Advocates Services office helps workers and employers with matters relating to workers’ compensation. Their services are free.

Once a review is requested, new information cannot be presented to the Decision Review Office. If you wish to share new information, send it directly to the person assigned to your claim. Their contact information is on the original decision letter. WorkSafeNB will determine if the new information is relevant to the decision. 

Yes, the Decision Review Office will inform you in writing if your decision review application can proceed. 

As per New Brunswick legislation:

  • You must request the review within 90 days after the original decision date.
  • You must have your decision reviewed by the DRO first before proceeding to an appeal through the Workers’ Compensation Appeals Tribunal (WCAT)

The Decision Review Office doesn't contact the worker, employer or their representative by telephone during the review process. The process consists of a review of the information in the file. You will receive a written communication from the DRO when your review is complete.

  • Reviewable Decisions – decisions made by WorkSafeNB under the Workers’ Compensation Act (WC Act), Firefighters’ Compensation Act (FC Act), and the Workplace Health Safety and Compensation Commission and Workers’ Compensation Appeals Tribunal Act (WHSCC & WCAT Act).
  • Non-Reviewable Decisions - not able or allowed to be examined or reviewed. Example: WCAT has decided on matter already.
  • Not Ready for Review – not able to proceed with a review at present time. Examples include: new information submitted, decision does not comply with Policy 21-113 Decision-making requirements, actions occurring at the initial level that impact the disputed issue, etc.
  • Not in Scope – services that may be requested that are outside of the DRO mandate, examples client service complaints, OHS matters or privacy breeches.

Yes, you can add up to 10 decisions for review. In the Decision Review section, select Add Another Decision.
